{"id":38,"date":"2023-05-11T10:58:52","date_gmt":"2023-05-11T09:58:52","guid":{"rendered":"http:\/\/doron"},"modified":"2023-08-03T20:52:51","modified_gmt":"2023-08-03T19:52:51","slug":"examine-every-step-to-understand-the-failures-better","status":"publish","type":"post","link":"https:\/\/divort-notar.md\/?p=38","title":{"rendered":"Cum func\u021bioneaz\u0103 partajul averii dup\u0103 desp\u0103r\u021bire: Ghid informativ"},"content":{"rendered":"\n<p><strong>Desfacerea c<\/strong><strong>\u0103<\/strong><strong>s<\/strong><strong>\u0103<\/strong><strong>toriei este un proces complex <\/strong><strong>\u00ee<\/strong><strong>n care se solu<\/strong><strong>\u021b<\/strong><strong>ioneaz<\/strong><strong>\u0103<\/strong><strong> mai multe <\/strong><strong>\u00ee<\/strong><strong>ntreb<\/strong><strong>\u0103<\/strong><strong>ri comune a so<\/strong><strong>\u021b<\/strong><strong>ilor: stabilirea domiciliului copilului minor, stabilirea pensiei alimentare <\/strong><strong>\u0219<\/strong><strong>i desigur, partajul propriet<\/strong><strong>\u0103\u021b<\/strong><strong>ilor <\/strong><strong>\u00ee<\/strong><strong>n dev<\/strong><strong>\u0103<\/strong><strong>lm<\/strong><strong>\u0103\u0219<\/strong><strong>ie.<\/strong><\/p>\n\n\n\n<p>Conform art. 1 din Protocolul nr. 1 la Conven\u021bia European\u0103 pentru Ap\u0103rarea Drepturilor Omului, orice persoan\u0103 fizic\u0103 sau juridic\u0103 are dreptul la respectarea bunurilor sale. Nimeni nu poate fi lipsit de proprietatea sa dec\u00e2t pentru cauz\u0103 de utilitate public\u0103 \u015fi \u00een condi\u021biile prev\u0103zute de lege \u015fi de principiile generale ale dreptului interna\u021bional.<\/p>\n\n\n\n<p>Partajul este o procedur\u0103 prin care \u00eenceteaz\u0103 proprietatea comun\u0103 asupra bunurilor (mobile sau imobile) care apar\u021bin mai multor persoane (fo\u0219ti sau actuali so\u021bi, mo\u0219tenitori, persoane care au cump\u0103rat \u00een comun, sau au devenit coproprietari \u00een alte circumstan\u021be). Mai simplu spus, partajul este \u00eemp\u0103r\u021birea bunurilor comune \u00eentre coproprietari.<\/p>\n\n\n\n<p><em>Contractul de partaj al averii so\u021bilor <\/em>se \u00eencheie \u00een form\u0103 autentic\u0103 c\u00e2nd coproprietarii se \u00een\u021beleg asupra cotelor ce revin fiec\u0103ruia. Prin urmare, nu este nevoie de divor\u021b pentru ca so\u021bii s\u0103 treac\u0103 anumite bunuri \u00een proprietatea exclusiv\u0103 a unuia dintre ei.<\/p>\n\n\n\n<p>\u00cen principiu, so\u021bii au dou\u0103 c\u0103i prin care ar putea s\u0103-\u015fi partajeze averea. Pot fi supuse partajului doar bunurile ce constituie proprietate comun\u0103 a so\u021bilor, conform Codului Familiei.<\/p>\n\n\n\n<p>Cea de-a doua op\u021biune este mai complex\u0103.
